Descendants of Sephardic Jews from Portugal, who left the country due to the persecutions promoted by the Inquisition in the Iberian Peninsula, between the 15th and 19th centuries, are entitled to Portuguese nationality. The descendant needs to prove belonging to a Sephardic community of Portuguese origin and present the certificate of the Jewish community with the status of religious legal person. There is no descent degree limit for the request. With the new regulation of the Portuguese Nationality Law, it is now also necessary to prove links with the Portuguese community, such as the right to inherit real estate, shareholdings in commercial companies or cooperatives based in Portugal or regular trips to Portuguese territory. Don't waste time: there are proposals to amend the Portuguese Nationality Law being evaluated by the Portuguese Parliament and the right for descendants of Sephardic Jews may be extinguished at the end of 2023.
For the children of Portuguese parents, who were registered by the Portuguese, up to the age of 18, there is the right to Portuguese citizenship. In this case, if the child is alive, the Portuguese nationality can be transmitted from father to son until reaching the great-grandson of the Portuguese. If the child of the Portuguese parent is no longer alive, Portuguese nationality can be transmitted from grandfather to grandson. It is important to have the help of a qualified professional to make the proper legal framework, as each case is unique. This is especially true for the grandchildren of Portuguese people because they can access the right to Portuguese nationality by attribution, but they must prove their Portuguese ancestry with certificates and links with the Portuguese community, which can be knowledge of the Portuguese language.
Foreigners in marriage or stable union with a Portuguese person can apply for Portuguese nationality, regardless of gender. For couples without children, it is necessary to prove at least five years of marriage. If you have children registered as Portuguese, the minimum time of union decreases to three years. In some cases, it will be necessary to prove a connection with the Portuguese community. The presentation of the marriage certificate or judicial recognition of the stable union is essential for the application.
For those who are children of foreigners, but born in Portuguese territory, there is the right to Portuguese nationality. However, for this to happen, one of the parents must legally reside in Portugal at the time of birth, or reside here, regardless of title, for at least one year.
Foreigners who reside legally in Portugal for at least five consecutive or interspersed years, within a period of 15 years, may apply for dual nationality by acquisition. Foreigners who are not from Portuguese-speaking countries must prove proficiency in the Portuguese language.
Estrangeiro que adquiriu a nacionalidade portuguesa de forma derivada pode transmitir o direito aos filhos menores de idade. Em alguns casos será preciso comprovar vínculo com a comunidade portuguesa.
